Our Terms

Introduction
These legal terms and conditions ('Terms') are between you and Quirk Money Ltd (“Quirk”, “us”, “we”) and you agree to them by using the Quirk app and our website (https://quirk.money), which we refer to collectively as our “Services”. 

You should read these Terms along with our Privacy Policy and Cookie Policy, and only use our service if you are over 18. 

These Terms have no fixed or minimum duration. They will apply until either you or we end this agreement. Please read these Terms carefully and make sure that you understand them. We amend these Terms from time to time as set out in term 9.

These Terms and all information will be in the English language. If there’s anything you don’t understand, please get in touch with us by emailing hello@quirk.money.

2. What is Quirk
Quirk is a personal finance platform with the goal of helping you save more and make smarter financial decisions. There are 3 key parts to Quirk:

- Money personality test: Through a 25-question questionnaire Quirk assigns you to one of four money personality types that suggest your attitudes towards money. 
- See your  accounts in one place: By using a regulated Open Banking provider you are able to access details of your transactions and balances from UK bank accounts.
- Track a budget and get spending notifications: By aggregating your account information, Quirk will automatically categorize your spending data and send you notifications and reminders for upcoming payments or when spending over the budgeted amount. 

Quirk helps you in managing and tracking your finances. We are not providing you with financial advice and we are not authorised to provide advice under the Financial Services and Markets Act 2000. If you require such advice please seek advice from an authorised adviser.

3. Connecting your personal bank accounts and credit cards
To be able to use Quirk you will need to connect your online personal accounts, such as current accounts and credit cards with secure read only access. 

Quirk is an agent of Plaid Financial Ltd., an authorised payment institution regulated by the Financial Conduct Authority under the Payment Services Regulations 2017 (Firm Reference Number: 804718). Plaid provides you with regulated account information services through Quirk as its agent.

We will redirect you to your account provider via Plaid Financial Ltd who will enable you to securely and safely connect your personal bank accounts or credit cards so we can access information about the balances and transactions on your connected accounts.

You will be asked to authenticate through your account provider and give consent to Plaid Financial Ltd before we can access this information.
 
To comply with regulation, we will periodically ask you to renew your consent. 

If you no longer want your personal account information to be displayed in the App nor stored by Quirk, you may remove these accounts from within your settings in the App or by emailing us at hello@quirk.money.  

End-users can withdraw their consent from Plaid by:

- deleting their connected account(s) in the Plaid Portal (to do this, an end-user has to access the Portal to manage their connections),
- requesting to be forgotten (by emailing Plaid at regulatory@plaid.com),
- alternatively, the consent only lasts for 90 days, and so once the 90 days elapses and the end-user does not re-authenticate with Plaid, the consent will be automatically withdrawn.

If you do withdraw (or fail to renew) your consent, Quirk will no longer be able to track your spending, give you spending insights or send you notifications on your budgets. 

4. Accuracy of financial information
Quirk won’t check the accuracy of the information given by your personal account providers and won’t be able to correct or investigate your personal accounts on behalf of your providers. You should check your personal accounts if you think you might go overdrawn and/or you are not sure if you have enough money to make a payment. We are not responsible for ensuring that you are always aware of your personal account balances, or that the balances we show you are always up to date. We are not responsible for any action you choose to take as a result of any information or notification we provide.  

If you set up any notifications with Quirk, you acknowledge and agree that these will not be based on real-time information so should be seen as a guide only. You should not rely upon any notifications on Quirk to manage your financial affairs or mitigate fraud. You are responsible for monitoring your personal accounts accurately. Quirk is not responsible for any losses you suffer as a result of your reliance on notifications set up with Quirk. 

5. Personality Test
You will be able to use our website or app to take a free personality test (the “Personality Test”). The results of the Personality Test are automatically analysed and you will receive a result which will assign to you one of four different personality types along with a description of the traits of the particular personality (the “Test Result”). We may also record and use your answers and results for research purposes. The Personality Test is provided for information and entertainment purposes only and for no other purpose. Our Services should not be regarded as or relied upon as being a comprehensive opinion or assessment concerning your psychological well-being or your financial wellbeing. Any decisions that you make once you have read the content of our Services are for you alone and we will not be liable for the consequences of any such decisions. Our Services are for personal use only and are not intended for use in any business, employment or recruitment context.

6. Your account security
When you create an account, you are asked to create a 4-digit security passcode which you must keep secret. If you forget it, we will be able to help you reset it in some circumstances. We’ll never ask you to tell us your passcode so you shouldn’t share it with anyone, even if you think they work for Quirk. 

The App may also use your device’s biometric capabilities (such as fingerprint or facial recognition) to give you access, if you choose to enable these.

As with any service holding your financial information, it is important to keep any login details secure. We will ensure that your Quirk security credentials are not accessible to other parties and are transmitted through safe and efficient channels. 

If the device on which the Apps are installed or accessed, is lost or stolen, or you suspect that someone else might know your passcode, you must tell us immediately and we will help you change your passcode. Quirk is not responsible for any of your losses which result from your security PIN being disclosed to anyone else, or accessed by anyone else. 

7. Third Party Partners
Our Services may provide website links and hosted functionality from third parties. The use of third party products or services is governed by the terms and conditions of the relevant supplier. The content and operations of third party products and services is outside of our control, and we cannot accept responsibility or liability for the products and services provided to you by these third parties.

8. Intellectual property rights
All intellectual property rights in any content of the Services (including text, graphics, software, photographs and other images, videos, sound, trademarks and logos) are owned by Quirk or our licensors. Except as expressly set out here, nothing in these terms gives you any rights in respect of any intellectual property owned by us or our licensors and you acknowledge that you do not acquire any ownership rights by downloading content from the website.

9. Changes to these Terms
These Terms are subject to continuous review and update, therefore we reserve the right to make changes to these terms from time to time and inform you of any significant change.
